General Terms and Conditions for Sailing Yacht Cruises


1. Definition of Parties

1.1.S&S, a brand of QUIB.RO: is the luxury cruise operator responsible for organizing, ensuring the safety of, and executing the cruise in accordance with the presented offer.

1.2. The Client: The individual purchasing S&S services, including participants listed under their booking.
1.3. The Crew (Staff): Qualified personnel employed by S&S, including the skipper, responsible for navigation, safety, and assistance during the cruise.


2. Booking

2.1. Booking Confirmation: A booking is confirmed only after full payment is received as per the agreed terms.
2.2. Cancellation and Refund Policy:

  • Bookings are non-refundable if canceled by the Client.
  • When a cruise product was purchased in installments, the installment payments for the remaining balance are divided into equal installments, calculated starting from the month following the advance payment and up to one month before the embarkation date. After two consecutive delays or missed payments, the reservation is canceled, and the amounts already paid are non-refundable.
  • If S&S is unable to deliver the contracted services due to its own fault or if natural, legal, or political conditions beyond S&S’s control prevent the cruise from proceeding as planned, the paid amounts will be credited toward future cruises, with no further financial compensation.

3. The Cruise

3.1. Cruise Program: The cruise will follow the destinations and itinerary specified in the offer, except in the following cases:

  • Decisions made by the skipper due to safety concerns (e.g., adverse weather conditions, local political situations).

3.2. Included Services:

  • Accommodation in double cabins allocated randomly, respecting gender separation where applicable.
  • Bedding and towels.
  • Skipper services for navigation and coordination.
  • Use of a motorized dinghy.
  • Yacht insurance for unforeseen incidents.

3.3. Excluded Services:

  • Food and meal preparation (unless a chef is hired).
  • Provisions, fuel, water, electricity, port fees, tourist fees, customs fees, and other local charges.
  • Recreational or sporting activities and related equipment (e.g., diving, paddleboarding).
  • Damages caused by negligence or intentional actions by the Client (e.g., clogged toilets, broken hatches, or dishes).

4. The Yacht

4.1. Specifications: The yacht will match the specifications described in the offer. Any necessary changes will be communicated in advance:

  • If the change constitutes an upgrade, no additional costs will be applied.
  • If the yacht is smaller, the comfort and space-per-person ratio will remain comparable.

4.2. Facilities:

  • Double cabins with private bathrooms.
  • Fully equipped kitchen for shared use.
  • Motorized dinghy.

5. Client Obligations

5.1. Boarding Conditions:

  • Full payment of services before the cruise begins.
  • Signing the contract and safety measures agreement.
  • Providing a valid identification document for all participants.
  • Declaring accompanying persons (children, elderly, etc.), with the Client assuming full responsibility for them.

5.2. Onboard Conduct:

  • Notifying S&S of any special requirements (e.g., allergies, medical conditions) at the time of booking.
  • Complying with safety rules and crew instructions.
  • Wearing safety equipment if unable to swim.
  • Avoiding indecent behavior, excessive noise, or actions disturbing other passengers.
  • Maintaining the good condition of shared spaces and equipment.

5.3. Personal Responsibility:

  • Clients are responsible for their personal belongings and for damages caused by themselves or their companions.
  • Any material damage must be repaired at the Client’s expense.

6. Crew Obligations

6.1. The crew will:

  • Ensure the safety and comfort of all passengers.
  • Promptly communicate any itinerary changes, risks, or special circumstances.
  • Assist Clients with information and technical support during the cruise.

6.2. The crew cannot be held responsible for incidents caused by the Client’s failure to follow rules.


7. Data Protection (GDPR)

7.1. Data Collected: S&S collects personal data necessary for booking management and cruise operations, such as names, contact details, and identification documents.
7.2. Data Usage: The data will only be used for operational and legal purposes (e.g., insurance, cruise management).
7.3. Client Rights:

  • Right to access their personal data.
  • Right to correct inaccurate or incomplete data.
  • Right to request data deletion, except where required by law.
  • Right to object to data use for marketing purposes.

8. Rights to Photo and Video Materials

8.1. During the cruise, S&S may create photo and video materials for promotional and marketing purposes (e.g., brochures, website, social media).
8.2. Usage Conditions:

  • Images featuring Clients will only be used in decent contexts and poses.
  • Clients have the right to refuse the use of their images by providing written notice before the cruise.

9. Force Majeure

S&S will not be held liable for delays or failure to perform its obligations due to events such as natural disasters, pandemics, political conflicts, or other unforeseen circumstances.


10. Acceptance of Terms and Conditions

The payment represent the Client’s explicit acceptance of these Terms and Conditions.
